BuyAlerts marketing texts settlement
BuyAlerts, a Miami fintech company, kept sending marketing texts to people who had replied STOP, and texted numbers on the National Do Not Call Registry, the lawsuit says. BuyAlerts denies it. People who got more than one of these texts in a 12-month period between January 1, 2022 and August 7, 2026 can claim up to $42.16 from a $3.6 million fund; the amount goes down if many people claim.

About the case
The settlement resolves a lawsuit alleging that BuyAlerts sent text messages selling its products or services within a 12-month period after people replied STOP or a similar opt-out instruction, or while their numbers were on the National Do Not Call Registry, in violation of the Telephone Consumer Protection Act and the Florida Telephone Solicitation Act. BuyAlerts denies all allegations of wrongdoing.
There are three classes: people in the United States texted after replying STOP, people in Florida texted after texting STOP at least 15 days earlier, and people in the United States texted more than once in 12 months while on the Do Not Call Registry for at least thirty days. Each person may file one claim; payments are reduced evenly if the fund cannot cover every approved claim at the full amount.
